Satyam Computer Services has won its case in the WIPO Arbitration and Mediation Center, Geneva, to recover domain names: satyam.net and satyam.org. The respondent was a computer programmer of Indian origin, living in the USA.
Seema Dubey, general manager - legal, Satyam, said, “This victory is remarkable in that the entire process was online. The petitioner was in India, the respondent was in the USA, the arbitrator was in the UK and the complaint was filed in Geneva.
“There was no protracted litigation, travel or high expenditure involved. The whole process was quick, too. We filed the complaint by email on July 20, 2000. The complaint was notified on August 21. After this the administrative panel was constituted and judgment was delivered before the deadline date of October 31.
“However the process is not as simple as it looks. We had to present all facts in great detail and list out all proof, including press clippings about the prolonged usage and our rights over our brand name Satyam.”
The panel found that the respondent had registered the domain names in bad faith, to disrupt the business of a competitor and to attract Internet users to his site for commercial gain.
